I just did my test. I editted the comm chair model so that it remains open, and as you can see, there is no commander inside. Though notice uptop, it says the chair is occupied.
This was the only command chair on the map.
Though an interesting point, the marine submodel is still in the command chair .mdl file. It just isn't drawn in the game. I have no idea why the NS team would do that. Perhaps they are thinking of reintroducing the occupied chair model in a later release, but I would still be missing the reason for removing it in the first place. It worked fine before.
So what does this mean? It means that any custom attempts at having a command chair with a visible commander, would mean that commander is always there even if the chair is unoccupied.

I see. A crude but effective method of achieving the effect. Though, I have considered this method, I think in the end it would just be best to have the guy in the chair all the time. I can just imagine myself getting spooked out by a floating commander that sunk through the floor.
It works pretty well because most NS maps only have one level. This is so the commander can see the whole map unobstructed. But not every part of the maps is designed that way.
