About freaking time.

I really hate Teresa Heinz for that lawsuit. She sued my family and tried to extort millions out of us.

My uncle was the pilot of the helicopter in the crash. Ms Heinz siezed on the opportunity and tried to sue our family for wrongful death of her husband. Despite the fact that my uncle flew helicopters in Vietnam and was a professional helicopter pilot every day since. And that the pilot in Heinz's aircraft only had 3 hours flight time in the type of plane he was flying. Contrasting to my uncle's 10,000+ hrs.

That *euphemism* really makes my blood boil whenever I heard her reference the accident. I am sure she was truly devistated when she got the news of the accident. So were we. Only we didn't turn around and sue for millions of dollars.


I liked Senator Heinz and it was terrible when he, my uncle, and the other pilots were killed in the accident. But I think he would be rolling in his grave if he saw how his widow was living off his legacy. ( I met him once and I can't believe how these two were ever married)

Sorry if I ranted a bit, it's a bit of a sore spot with me. I really would despise watching this woman become first lady.

    Small price to pay for getting someone into office that is not the best candidate but will do a heck of a lot better than the one we currently have in office. I feel sorry for your loss but I am more concerned with the people we haven't lost, the people that will be lost if Bush is re-elected.

    Huh?

    Anyway, as much as i would love justice be served in all situations, i can only see this as a cheap attempt at a smear campaign on John Kerry. This will be considered his scandal, and severely impact people's impressions of him, although it has no reason to.

    I have a feeling the judge who reopened the case is not out to serve justice, but really out to serve Bush.

    I'm impressed. Only in the article was Senator Kerry's name mentioned, wizzard didn't even mention it once, and yet the very first reply has to do with polotics. *sigh*

    Why were the records sealed in the first place anyway?

    But yes, I'm curious, I mean, why does a senators widdow sue them. Was his uncle the owner of a flight service agency of some sort? Did he rent Helicopters?
    I was just curious, because sueing someone for a million dollars only makes sense if you can get them right?

    That was maybe a bit tasteless, so again I apologize.

    heh, court is over.

    This was settled 10 years go. The crash was in April 1991.

    I'll give a rundown of what happened.


    Senator Heinz's plan was having mechanical issues and needed to land. However they were getting a warning that the gear was not all the way down which is pretty much the worst position it can be in. (if its up you do a belly landing, down you land fine, half way and your plan will likely flip on landing).


    So my uncle, was asked to fly next to the Senator and see if the gear was down. They did the check and then problems happened. My uncle gave the pilot of the Senator's plane an all clear to land. The pilot of the plane then proceeded to turn towards the airport. The problem was that my uncle's helicopter had not yet left the area and the airplane turned directly into the rotors of the helicopter.

    The two aircraft collided and fell like a rock onto an elementary school playground during recess. It was pretty bad.


    So, who was at fault? The case is closed so I can comment freely. The pilot of the plane made a terrible error by turning left before the helicopter had left the area. That was the official stance of the FAA.

    However, it really was a dangerous maneuver. My uncle had a lot of flying experience (former Army/CIA pilot) and could perform such maneuvers. However he should have known that the pilot of the plane probably did not have experience in close quarters maneuvering. All in all it was terrible for all involved.

    It was also my first experience with the media as they were trying to sneak into the funeral for my uncle. There were about 5-10 news crews kept off church property by the police. The reason was because there was a huge conspiracy theory because Senator Heinz was 'the next president' and my uncle's role in the Army/CIA just sent the tinfoil hat crowd nuts. Really surreal.

    I don't get it. Some inexperienced idiot flies right into your uncle's helicopter (as the other person was flying an airplane, it obviously would've been THEM who crashed into the helicopter, not the other way around). Everyone dies. The bitchy wife of the senator who was in the plane sues your family for millions, even though she already HAS millions, as if you have anything to do with it? And also, someone in your family died in the accident. Damn rich people (I use the term "people" loosely).

    The fact that she had money doesn't mean she doesn't have the right to claim money if in fact there had been a wrongful death. It is completely seperate that in this case there wasn't a wrongful death.

    It should not be said that it is obvious that it was the aeroplane's fault because somehow the helicopter couldn't have crashed into the plane. I'm sure it is possible for a helicopter to hit a plane. Again, this is not the case in this instance, but that doesn't automatically mean that it can't ever happen.

    The helicopter pilot's family mightn't have "anything to do with it" if "it" was the accident, but they would be the beneficiaries of the health insurance policy, and if I'm not mistaken the money she claimed would have come from there. That's why they were taken to court.

    Wizard you said that she tried to extort money from your family. Are you refering to the court case, or to some other incident of attempted extortion? (Did you mean in the form of settlements?)

    The problem was that she didn't wait until the FAA investigation was complete. She sued first and then tried to find out what happened.

    The tactics she used were quite bullying. The highest income in my family at the time was my father who was only a steel worker. The problem was the cost of the lawyers.

    If she had waited until the FAA investigation was over then there would (should) have been no lawsuit. But she didn't and my family had to retain a lawyer for a very lengthy and expensive court case.


    My uncle was trying to save her husband's life. She could have at least recognized that.

    I think there is something morally wrong with the financial destruction of an entire family so that one already very rich person can pocket a few more notes (just look at my avatar!). And I think it would be quite difficult for an experienced helicopter pilot to crash into a plane, unless done on purpose.

    The decision came back as no fault (more or less).


    Frankly it should never have occured in the first place. My complaint was with the lawsuit and not the other pilot.

    I'm sorry for your loss, but arn't all court costs paid for if you win the suit? As in you don't have to pay anything? (Except time and energy of course)
