Hmm I've gotten that message before, in windows xp home I found that sometimes you have to kill hl in the process's tab before you can run it again, (think this only happens when you have hl in compatiblily mode or somethin..) or you get that error or something. Try exiting and check your process's tab and make sure hl.exe is gone then try again. It should work or maybe some haxor dumb luck generated your cd key and is now using it, then just contact valve or somethin...maybe you can exchange your hl cd for another one or somethin...

Besideswhich, it's difficult for a distributor to dictate the returns policy of their point-of-sale clients, unless they are accepting returns all the way to the factory. Which normally will NOT happen excepting in the case of a physical defect in the media.
At this point it's a 'buyer beware' situation more than anything else. In other words... DON'T BE A MORON. If you're getting a game with a CD key, get one with a sealed, shrinkwrapped box. Otherwise, it's just you risking some idiot pulling your key... like a few of the self-proclaimed 'ragers' who wander around Half-Life mods.
