Sorry, but what you're looking for just doesn't exist. The closest online thing to that is EVE Online, but it's pay to play and is about as exciting as doing taxes.
As for offline games, Frontier Elite and Frontier: First Encounters are close to what you want (no building stuff). The former is stupidly easy, and the latter is stupidly hard, and they are very old, but they are both <a href='http://www.eliteclub.co.uk' target='_blank'>free</a> so you have no excuse not to try them.
Freelancer is more modern, so it's probably closer to what you're looking for. It has an excellent control system that is very easy to learn and works very well. It's not exactly what you want, but its the closest you can get right now.

X Gold has almost of those - its just not online. The sequel has been mentioned already, X2, but since X gold is pretty cheap to pick up I suggest you try it?
Personally, I'm going to wait until they officially announce Elite 4 to decide which way I go. Freelancer is missing a couple of features that really kill the multiplayer (most notably pvp piracy is basically impossible, as you don't get any loot from killing a freighter, and the loot from npc freighters sucks too).
X-2 has one of the biggest learning curves I have ever seen in a game. The interface is awful. There's a lot of content floating around in there, but I didn't have the patience for it. BTW, it has no multiplayer, but they are releasing a pay-to-play multiplayer only version of the game sometime (if it's not already out).
you know what game would toataly own, space pirates, space and pirates.. to awsome things, so why not combine them. like, blow out ships engines and board them and loot.. and have a astroid with a giant skull on it :o

Well, I never really was a big fan of the way you piloted your ship in freelancer, and a new game that is MUCH better recently came out, called X-2. Try that, its supposed to be great, like the Morrowind of Space fighter games.
well, i would like it to be online so i can play with other people and make Spaceports and stuff.... A bit like a 3d version of TDZK if you know what i mean.
X2: The Threat is supposed to be a super awesome space game, especially for trading. But if you ask me, there's nothing better then the good ol' combat of TIE Fighter.
well that is Star Wars not Star trek... I will look into this X:the threat...
Edit: I have had a quick look at this game and it does not have Online capacity. I would like a game like freelancer but i want a online one. If there arent any around, i think that is sad because there is a huge gap market there to seize. If there are not any of those games, I think i will design one....
