Crediting Unreachable Model Authors

a question of morality
I'm sure everyone's familiar with the dilemma surrounding permission vs stealing other modelers' work. If I wanted to make a hackjob based on Modeler X and Modeler Y's models, and cannot reach Modeler X, even though Modeler Y says yes, what's there to do?

In a simple cut-and-dried response, the answer would be no. However, how simple can one base it when they cannot reach the modeler in question?

How do they understand the modeler's motives if they cannot contact them?

Now here's my situation. I have a bunch of models from the Project Timeless mod. I've asked the mod leader for permission to use them, and have been redirected to Warbeast, the creator of the models in question. I also have contacted the makers of a MAC-11 model and a TMP model. They have since responded with their thanks and request that I credit them. I have done so.

So now I'm stuck with a collaboration between three modelers and two skinners, and all but one have given me a "yes". I haven't been able to contact Warbeast via his site or by email.

So now I ask the question to my fellow modelers: Is it alright to release or not? And to my fellow hackjobbers: What would you do in this situation?

ok, here's my view on the subject:

    include the original readme
include name and reference to readme in *your* readme
if applicable, even include original model.

    then release.

you could even write a note saying that you tried to contact original author, but couldn't, so in your best efforts, have creadited the whole pack to the original author...

and list where you got the original model from

I'd go with exhausting every avenue, and then at the very end just include his original readme and a wee bit about "if you want this removed blah blah please contact etc etc". If his readme is rather explicit about NOT passing on his work, then I wouldn't do it, period.

For some of the Alien v model stuff I did it was quite a while waiting to get some people's permission, and I had to chase down one person on another message board. Got the permission, released, no problems.

Its good that you've mentioned this in the forum, where at least you're moderately known and we all respect people's rights. You've that in your defence should anything come up - as compared to some faceless smacktard noob hackjob where you can't really believe them when they say they tried their best.

GJ on making the effort to ask permissions!

try to contact them, but certainly add the correct credits in the readme, for every single thing you used

Either build the part of the hack you can't get permission to use yourself, or find a different source for a similar model part. If you don't know you're allowed to release something, you don't release it.

Well I dunno about "most" because every one I've ever seen has got quite irate at people hacking their work WITHOUT PERMISSION.

I would however agree that most don't mind their stuff being used IF ASKED.

Maus raises a good point - is there any way of replacing the part you don't have permission for? Just on the offchance that the guy is assuming that by not replying you'll get the message that he doesn't want you to use it...

Not that simple, considering I can't mesh or skin. I could try my hand at it, but it'd be nowhere near the quality I'd be comfortable releasing with.

Actually I did get two replies from two different email addresses just last night. They were automated. The addresses no longer exist.

Well you've done everything you can, from the sound of it...

If they are so far out of it as to be unreachable, they are probably no longer involved with the items enough to be concerned about how they are used, with the provision that proper credit is given to them, as it should be always. Where proper credit is given, it is more like quoting one author within the context of another story- the text is used to fill in part of the picture, and enhance the current work, but noone is attempting to claim it as original...
