No, that does not seem to be legal. Im not 100% sure about the legal issues involved, but I cannot be bothered to pick up a book and investigate them. Not yet anyhow, its certainly something I may look into.

Is it legal? No. Flayra owns the copyright on all found within Natural Selection, and I doubt he written permission was obtained for this project. It's falls under intellectual property rights. So Flayra has only to issue a cease & desist, and it'll be down.
Be also understand that if Flayra did so, he might end up with a few nay-sayers, and more than a few comparisons to Fox. The author is crediting NS, and not trying to steal credit at all. It is a labor of love.
From what little I've known of Flayra from these boards, Flayra is too much of a hippy <!--emo&;)--><img src='http://www.unknownworlds.com/forums/html/emoticons/wink.gif' border='0' valign='absmiddle' alt='wink.gif'><!--endemo--> to rip it down. But be assured that he will still make sure that proper credit is documented.

I wouldn't mind if Flayra told them to stop it or remove it. If the team put the time and effort in it, they should have a right to claim it as theirs.

But I wouldn't frown upon the NS team for shutting that model down on Custom TFC because it is their work and they do hold copyright rightfully.
I doubt anyone on the forums here would frown upon it. The NS team put work into their models and textures. This person gets the congratulations for porting it to TFC, with a minimum of work.
But how would fans of TFC who happen to like a game of NS now and again feel? What of those TFC fans who may be introduced to NS this way?
